In a letter, the Minister of Asylum and Migration proposed measures that should begin to limit sham constructions, poor working conditions and undesirable knowledge transfers. One of these measures involves prohibiting the loaning of highly skilled migrants to third parties. This affects organizations that need specific knowledge, but cannot hire highly skilled migrants due to their status as start-up or scale-up and/or not (yet) a recognized sponsor.
If an organization wants to hire a highly skilled migrant, it must apply to the IND (Immigration and Naturalization Service) to be recognized as a sponsor. Recognition as a sponsor has a number of advantages such as faster processing time for applications. However, recognized sponsors are also subject to a number of legal obligations such as the duty to provide information and duty of care.
Recognition as a sponsor is not obtained overnight. The application process is long and especially uncertain, especially for SME. But obtaining this special status is only the first step. A new recognized sponsor then faces the complexity of applying for a residence permit.
Besides collecting a lot of information from the potential highly skilled migrant, specific and recent forms are needed as well as legalized and translated official documents. In addition, the authorized referent will need to have the necessary knowledge to assess whether all conditions can be met. Incomplete and incorrectly submitted applications can lead to a delay of weeks or even months or even a negative decision.

It remains to be seen whether an increased number of recognized referees is the solution to abuse in lending structures. The ABU (Algemene Bond Uitzendondernemingen) expects that especially the SME will be affected by the measures because they often do not qualify for recognized sponsorship. At the same time, an increased number of recognized sponsors (applications) will lead to an increase in the regulatory burden for the IND.
